Definitions

1.1 The "Client" means the person/s, organisation or company booking the equipment, with the "Company".

1.2 The "Company" means Timeless Games

 

Bookings

2.1 All equipment remains the property of the company at all times.

2.2 By placing an order with us either verbally or via e-mail regardless of whether a booking form has been returned or deposit paid it is deemed that the customer has read, understood, fully agreed to and is bound by all our terms and conditions of hire.

2.3 In the event of traffic or other uncontrollable circumstances preventing Timeless Games from being able to fulfil our contracted obligations our liability shall be limited to a refund of any monies paid in relation to the contracted event. No further compensation will be paid.

2.4 We can accept bookings in writing, by telephone or via email. If we have verbally agreed to accept your booking by any of the above methods a contract has been entered into and full terms and conditions apply from the time your booking is accepted. This applies irrespective of whether a booking has been acknowledged in writing or by email by Timeless Games or whether any booking fee has been sent or received. When a booking is made it is assumed that the customer has read, understands and fully agrees to the terms and conditions of hire.

2.5 Where a request is made to change the date and or times of the hire we will do our best to rearrange your booking. All booking fees are non-refundable. Notwithstanding this our cancellation policy is as stated in ‘cancellations’. Bookings are non-transferable.

2.6 Timeless Games accept no responsibility for bad weather and no refunds will be given in this event.

2.7 Bookings and timings will be discussed prior to the contract being drawn up and confirmed by signed contract.

 

Prices, Deposit & Balance Payments

3.1 All hires are subject to a booking fee which is non-refundable.

3.2 The balance to be paid in full and cleared 4 weeks prior to the event start date.

3.3 Advertised prices are subject to change without prior notification.

3.4 Payment terms will be discussed and agreed at the time of booking. Where we agree to accept payment after the event this must be received within the time specified on the invoice.

3.5 We are able to accept payment by Cash, Paypal & Bank transfer. We do not accept payment by cheque.

 

Cancellations

4.1

Any cancelled order is subject to the following cancellation charges:

Within 8 weeks prior to event 25% of order value

Within 6 weeks prior to event 50% of order value

Within 4 weeks prior to event 75% of order value

Within 2 weeks prior to event 100% of order value

 

Equipment

5.1 Timeless Games reserves the right to substitute hired equipment with equipment of a similar type and value without notice in the event of previous damage or loss of booked equipment.

The games and equipment are supplied by Timeless Games in good working order. If a game or piece of equipment has to be withdrawn from a booking due to unforeseen circumstances, then Timeless Games will liaise with the hirer to discuss substitution where possible. However, if this is on the day of the booking, we will endeavour to provide a replacement or come to an agreement with the hirer.

5.2 Timeless Games reserve the right to amend or alter any product specifications without prior notice.

5.3 All goods remain the property of Timeless Games at all times.

 

 

Site Location, Facilities & Conduct

6.1 Hired equipment will be set up in one location only as agreed on arrival and will not be moved once unloaded.

6.2 It is the responsibility of the client to ensure the venue is in agreement to have the equipment set up for the event.

6.3 Timeless Games reserve the right to refuse set-up if the venue or site is deemed to be unsuitable or if the client has failed to notify the company of any obstructions such as excessive loading distances from our vehicle to the installation site. In such a case no refund will be given and the full hire fee will be due.

6.4 The company reserves the right to cease operation and remove hired equipment from site if at any time a representative of the company feels that guests or clients conduct endangers the safety of the guests, clients, themselves or the safety of the hired equipment. In such cases no refund will be given and full contracted fees will be due to the company.

 

Liability, Damage & Insurance

7.1 A £100 damage deposit will be paid to and held by Timeless Games, this will be returned in full on collection and inspection of all items hired.

7.2 In the event of any damage or theft of the company’s equipment whilst on hire, the damage deposit will not be returned.

7.3 If, for any reason, the damage deposit doesn’t cover the cost of repairing or replacing the damage, an invoice will be issued to the hirer detailing the amounts due.

7.3 The company accept no liability for any damage or loss of personal property and or any injury arising from the use of the hired equipment.

7.4 The hirer should ensure that young children are supervised at all times to avoid the risk of injury and ensure that   Timeless Games cannot be held responsible for safety issues which occur from the use of our equipment.

 

Use of photos and video

8.1 Timeless Games reserve the right to use photos and videos of an event, equipment and participants on social media platforms and promotional literature. Please let us know in writing on the booking form if there are any concerns regarding this.
